Whaler — Terms of Service

1. What Whaler is
Whaler is a customer-intelligence tool for live sellers ("breakers") on Whatnot. It helps a seller recognize their biggest buyers ("whales"), retain them, and — for subscribers who opt into the network — see cross-market whale intelligence. Whaler is an independent product and is not affiliated with, endorsed by, or sponsored by Whatnot.
2. Accounts & eligibility
You must be 18+ and provide accurate information. You are responsible for your account, your credentials, and all activity under it. One account per person/business unless we agree otherwise.
3. Subscriptions, billing & cancellation
- Whaler is a paid subscription (currently a Seller tier and a Marketplace/Premium tier), billed through Stripe. Prices are shown at checkout. Founder/early-adopter rates, once granted, apply for as long as your subscription remains continuously active.
- Subscriptions renew automatically until canceled. You can cancel anytime from the billing portal; access continues through the end of the paid period. Fees are non-refundable except where required by law.
- Taxes may apply. Failed payments may result in suspension or downgrade.
4. How data is collected — read this
Whaler builds its intelligence from information broadcast publicly during live Whatnot shows. When an auction closes on a live stream, the winning buyer's handle, the item, and the sale price are displayed publicly to everyone watching that show. Whaler observes this public live-show activity — either via the seller's own browser extension running on their own show, or via automated agents observing public live shows — and records the winner handle, item, and price.
- We do not access private messages, payment details, addresses, or any information not publicly visible in the live show.
- We record public sale events and aggregate them into (a) your own shop's CRM and (b), for network participants, market-wide whale intelligence.
- You are responsible for your own compliance with Whatnot's Terms of Service and applicable law in how you use Whaler alongside your Whatnot activity.
5. The Marketplace network & your opt-in choice
The premium Marketplace feature surfaces cross-seller whale intelligence — proven big spenders across the market, including buyers who shop at accounts your size but haven't found you yet.
This runs on a reciprocity model:
- Opt in (default for participants): your captured public-show sale data joins the shared network dataset, and in exchange you may access the Marketplace's cross-market intelligence.
- Opt out: your shop's captured data is excluded from the shared network dataset and is used only for your own private CRM. Because the Marketplace is powered by network contributions, opting out means you do not have access to the Marketplace/cross-market features. Your own-shop CRM is unaffected.
You can change your choice anytime in your account settings; changes apply going forward.
6. Buyer data & privacy
Sale events we record reference public buyer handles (usernames), items, and prices — not real names, contact info, or payment data. We publish a separate Privacy Policy describing what we hold, how long, and how a person may request access or deletion where the law provides that right. We aggregate and, where appropriate, limit how much individual buyer detail is exposed in the Marketplace. We do not sell raw buyer contact information (we hold none).
7. Acceptable use
Don't: resell or redistribute Whaler's data as a competing dataset; reverse-engineer or abuse the service; use it to harass or defraud buyers; circumvent the network opt-in/opt-out; or use Whaler in violation of Whatnot's terms or applicable law. We may suspend accounts that do.
8. Your content & our IP
You keep rights to your own shop's data. You grant us a license to process it to provide the service and, if you opt in, to include it in aggregate network intelligence. Whaler's software, brand, and aggregated datasets are our intellectual property.
9. Disclaimers & limitation of liability
Whaler is provided "as is," without warranties. Whale flags, spend figures, and market intelligence are estimates from observed public activity and may be incomplete or inaccurate — they are not guarantees. To the maximum extent permitted by law, Whaler is not liable for indirect or consequential damages, and our total liability is capped at the amounts you paid us in the prior 3 months. Nothing here limits liability that cannot be limited by law.
10. Termination
You may cancel anytime. We may suspend or terminate accounts for breach of these terms or legal risk. On termination, your access ends; we may retain aggregated/anonymized data consistent with our Privacy Policy and law.
11. Changes
We may update these terms; material changes will be notified. Continued use after changes means you accept them.
12. Governing law & contact
These terms are governed by the laws of Arizona, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located there. Questions: Whalerlive@gmail.com.
